Reseller Agreement

This Reseller Agreement (the “Agreement”) is made, entered into and executed on the date on which you electronically consent to the Agreement (the “Effective Date”), by and among you (“Reseller”), The sponsoring ICANN-accredited registrar (“Registrar”) identified in the WHOIS record which may be retrieved here, Aksaradata. The Registrar, Aksaradata is as the “Company.” The Company and Reseller may be referred to individually as a “Party” and collectively as the “Parties.” WHEREAS, the Registrar processes Customers’ domain registrations, renewals and transfers using the Registrar’s credential (“Registration Services”); WHEREAS, the Company provides Reseller Services and performs all technical, support and administrative functions relating to such Reseller Services, including Registration Services; and WHEREAS, Reseller wishes to purchase and resell Reseller Services. NOW, THEREFORE, for and in consideration of the mutual promises, benefits and covenants contained herein and for other good and valuable consideration, the receipt, adequacy and sufficiency of which are hereby acknowledged, the Parties, intending to be legally bound, hereby agree as follows:

1. Reseller shall not display the ICANN or ICANN-Accredited Registrar logo, or otherwise represent themselves as accredited by ICANN, unless they have written permission from ICANN to do so
2. Reseller must enter into a paper or electronic registration agreement with each of its customers substantially similar to the Domain Registration Agreement. The Customer Domain Registration Agreement shall contain all provisions and notices required by the RAA and any applicable ICANN Consensus Policies
3. Reseller shall identify the sponsoring registrar upon inquiry from Customer.
4. Reseller shall comply with any ICANN-adopted Specification or Policy that establishes a program for accreditation of providers of proxy and privacy registration services (a “Proxy Accreditation Program”). Among other features, the Proxy Accreditation Program may require that: (i) proxy and privacy registration services may only be provided by individuals or entities accredited by ICANN pursuant to such Proxy Accreditation Program; and (ii) Registrar prohibits Resellers from knowingly accepting registrations from any provider of proxy and privacy registration services that is not accredited by ICANN pursuant to the Proxy Accreditation Program. Until such time as the Proxy Accreditation Program is established, Reseller shall comply with the Specification on Privacy and Proxy Registrations.
5. Reseller shall clearly display on any website it operates for domain registration or renewal a link to the appropriate ICANN webpage detailing Registrant Educational Information (currently available at http://www.icann.org/en/resources/registrars/registrant-rights/educational).
6. Reseller agree that in the event Registrar learns that a Reseller is causing Registrar to be in breach of any of the provisions of this Agreement, Registrar shall take reasonable steps to enforce its agreement with such Reseller to cure and prevent further instances of non-compliance.
7. Reseller shall clearly display on any website it operates for domain registration or renewal a link to ICANN’s Registrants’ Benefits and Responsibilities (currently available at http://www.icann.org/en/resources/registrars/registrant-rights/benefits ) and shall not take any action inconsistent with the corresponding provisions of the RAA or applicable law

Term Of Service

1. Subscription fee: The customer agrees to subscribe in accordance with the contract rented in accordance with the order entered and has been approved.
2. Deposit : The deposit will be entered into the Customer's account and can be used to make transactions at Aksaradata. Deposits cannot be returned or withdrawn in cash, and cannot be transferred to other account holders. The deposit will expire if the Customer's Account is terminated or transfers the account to another customer.
3. Taxes: Customers are required to pay taxes in their country, province, or region, for all services rented at Aksaradata. Aksaradata collects 11% tax (VAT) from customers in Indonesia. Customer payments to Aksaradata are in full, and are not affected by tax deductions that apply as a rule in certain companies / institutions. Stamp fees and other costs arising from registration activities in Aksaradata which are administratively required by the Customer will be borne 100% by the Customer. If the customer requires a tax invoice, he can request it from Aksaradata.
4. Certain Terms of Service: Customers are required to complete the data completeness requirements for conditional Domains as written on the following page
5. Deposit Payment via Bank Transfer: Payment processing via Bank Transfer takes a maximum of 2 working days after confirmation of payment is made by the Customer.
6. Payment via Virtual Account : Payment processing via Virtual Account is carried out by the Customer by transferring a certain amount of funds to different Virtual account numbers in each Customer's account. Please transfer to the Virtual Account number that corresponds to the account used. If an error occurs when inputting the Virtual Account number, the payment made will be considered as payment for that Virtual Account number. This is entirely the responsibility of the Customer.
7. Domain Transfer: Domains with active status in Aksaradata cannot be transferred to another registrar if: they have not fulfilled the 60 Day active period; has not extended Domain (for Domain promo/Domain acquisition); and if the Domain has entered the 18 day period to expire

Refund Policy

1. Deposit funds cannot be withdrawn for any reason.
2. Convenience Fee is not included in the deposit

Privacy Policy

Aksaradata respects the privacy of customers/users of Aksaradata's services. Therefore, the following is an explanation of the Privacy policy between customers and Aksaradata

Aksaradata collects data regarding Aksaradata customers in the following ways:

1. Online Registration and Offline Form provided
2. Transactions and Requests for Sales, Billing, Abuse, and Technical Support
3. Online Communication of Customers to Aksaradata and Their Interactions
4. Offline Communication of Customers to Aksaradata and Their Interactions
5. Official Identity of Customer / Customer Company in the form of KTP / SIM / Passport, SIUP / NPWP / TDP, if required by Third Parties and Aksaradata
6. Statement Letter, Application Letter, Certificate, registration requirements, and related matters both offline and online
7. Original data for domain name registration and Aksaradata services
8. The data entered during registration by the Customer must be the correct data. Aksaradata will use the data for registration, and communicate to customers in any way.
9. Aksaradata has the right to use customer data for Aksaradata's internal purposes in improving the quality of service to customers.

Security of Customer Personal Data Aksaradata

Aksaradata guarantees the security of customer data entered into the database (Encrypted) Aksaradata both physically and electronically. The data collected will not be misused for use outside the Aksaradata network. If there is misuse of the data outside the reach of Aksaradata, then we will immediately take action and notify the Customer to replace the data Aksaradata does not sell customer data to any party, and will destroy or destroy customer data if the Aksaradata service is no longer used or not renewed by the customer, or at the customer's request

Use of Customer Data outside Aksaradata

The customer agrees if in the future Aksaradata is asked to provide customer contact information to official institutions / agencies from the police, government or state, both national and international levels. Apart from this need, the Customer's information will be kept confidential by Aksaradata so that it is not misused (and encrypted), except for the Customer's personal data that appears in the whois information, if this data is stored / cached or captured by other sites, then this is outside Aksaradata's responsibility

Acceptable Usage Policy

Prohibited actions on Aksaradata services and can stop the service without a refund and also without warning:

1. Sites that violate Indonesian Law or International Law
2. The site contains insults, terror, slander, fraud, fraud, phishing, immoral acts / pornography, in the form of images, text, photos, videos, and the like
3. Sites that sell or do business or transact GAMBLING, DRUGS, and drugs without permission from the authorities
4. Sites that can cause political and security conflicts, racial intolerance, incitement, cornering against certain people or groups of organizations or other parties
5. Sites that distribute or store copyrighted material that does not have a reproduction/broadcast license that violates the provisions of Intellectual Property Rights (IPR) or DMCA laws
6. Sites that offer Spaming, Hoaxes, hacking/cracking, Data Theft, Ponzi Schemes, and Scams
7. Sites containing futures or commodity investment trading types, using investment schemes, profit sharing or long-term profits, must obtain an operational permit from BAPPEBTI. AKSARADATA has the right to permanently suspend the service without any refund for the related Domain which contains the type of commodity futures trading, using investment schemes, profit sharing that DOES NOT HAVE PERMISSION from BAPPEBTI
8. Sites that contain types of trade in drugs, beauty drugs, and other drugs, must obtain a permit from BPOM. AKSARADATA has the right to permanently suspend services without any refund for related Domains that DO NOT HAVE a distribution or sales permit from BPOM

Auto Provisioning Policy

Auto Provisioning is a feature to be able to activate the domain first then you upload the required documents. This feature is useful for those of you who want to immediately have a domain available so you don't have to worry about the domain being registered by someone else

The Auto Provisioning Policy that needs to be known is as follows

1. Domain registrants are required to upload the required documents before 72 hours from the time of auto provisioning
2. If you have uploaded the Requirements Document, our team will review the document within a maximum of 24 hours
3. If after 72 hours you do not upload documents, the auto provisioning domain will be deleted.
4. Domains deleted due to the error / negligence of the domain registrar are non-refundable

Domain Life Cycle Policy

1. Available
   Domains in Available status are domains that can be registered by anyone unless the domain is premium.
2. Register
   

   Clients can choose one of two ways to register after completing payment, namely: First Way: Auto Provisioning or method. Second Way: Upload Documents. If the client chooses Auto Provisioning then the client does not need to worry about the domain being ordered by someone else because the domain is immediately activated, but if the client chooses Upload Documents first then the client must complete it before the domain can be activated.

   • Auto Supply
     The domain is activated immediately after we receive the payment, the client is given 3 days to upload the required documents according to the domain extension. If after 3 days we have not received the required documents, the domain will be available again and no refund will be issued.
   • Upload Document
     The client chooses to upload the required documents before the domain is activated, the client can still cancel the order if the client documents cannot meet the requirements of the ordered domain.

3. Active
   The active domain can be used by the client as long as the active period is paid. Domain cannot be transferred from AKSARA DATA for the first 60 active days or cannot be transferred to other AKSARA DATA Reseller (Moving Service) for the first 30 active days.
   • Update
     The domain can be renewed by the client before expiration to avoid suspension.
   • Expired
     Domains with Expired status will be suspended and given at least 35 days to renew. Domains cannot be transferred from AKSARA DATA when entering a period of 15 days before the validity period expires or domains cannot be transferred to fellow DATA AKSARA resellers (Moving Service) when entering a period of 7 days before the validity period expires.
4. Deletion
   The domain will be in Deletion status if it is not renewed more than 35 days from the expiration date.
   • Restore
     Clients can request a domain restore if they want to reactivate a domain that has entered the Deletion period, the cost of Restore domain = 6x the cost of Renew Domain.
   • Letting go
     Domain will be released if it has a deletion status of more than 37 days, this release process takes about 5-7 days, a domain in release status cannot be renewed or restored. after this process is complete, the domain will return to Available status.

Service Liability Limitation

Aksaradata tidak menanggung isi website Pelanggan dari kejadian-kejadian seperti:

1. Negligence of a Customer or Data Literacy Staff, whether intentional or unintentional
2. Hackers, or viruses and spam on Customer's website
3. System changes or disruption to the Aksaradata domain registrar system located overseas or domestically / Holiday Registrar
4. There is a change from the internet system around the world
5. Domain hijacking / deletion of domain names from system due to late paying customers
6. Moving Aksaradata datacenter server resulted in a change in IP Address
7. Force majeure, natural disasters, and internet disconnects

The things mentioned above are events beyond Aksaradata's control or an emergency, therefore the Customer cannot file a claim against Aksaradata in any form.

Domain names registered through Aksaradata are only for rental for a certain period of time. There is no permanent ownership of the domain name. If the domain name leased by the Customer through Aksaradata cannot be used for any reason, then it is beyond Aksaradata's responsibility because Aksaradata's function is only as an intermediary to register the domain name.

Registration of domain names is First Come & First Served, Customers will not blame Aksaradata if the domain that Customers want to register on the Aksaradata website has been used by someone else before being registered by Aksaradata. Even if this happens on the same day/hour or along with a holiday, outside the working hours of the related Aksaradata staff, or because the payment is incomplete or the data is unclear or the Customer does not confirm the payment. Or also the domain name has been used or registered by someone else for a long time, or cannot be registered due to things beyond Aksaradata's control, one of which is: Premium Domain

Domains that have been registered by Customers in Aksaradata, can be deactivated or requested to be replaced, or their use canceled if there are cases of Copyright infringement or trademark infringement, or there are other cases that can cause problems with the domain name .

Domains that were once registered with Aksaradata, but the domain services were diverted from Aksaradata, or the domain services were discontinued, then since then the domain is outside Aksaradata's responsibility.

Service Level Agreement

Customers who use services at Aksaradata declare and agree that the services used are entirely the responsibility of the Customer, the Customer will be responsible for the losses suffered by the Customer directly or indirectly, or losses due to loss of income/ the tangible benefits that the Customer expects. Customers, and demands from any party for the disruption of Aksaradata services. If the incident occurs, then the Customer does not blame Aksaradata in any form; Aksaradata does not bear any damage, loss of data, damage to computer systems, and does not provide any compensation, resulting from the use of Customer's services or applications on Aksaradata. Aksaradata will contact the Customer using the Customer's primary email address contained in our database. Customers are also required to change or update their email address in our database if the Customer wants to be contacted with a different email address, or the Customer's email is having problems. Aksaradata will try to keep as best as possible the Customer data on the Aksaradata server that is personal or confidential, such as: database, or data in the Customer's home directory, unless the Customer himself manages the settings so that the data can be displayed to other parties Aksaradata has the right to refuse registration of the Customer deemed to be suspicious and would be fatal if accepted, or contain elements related to criminal acts such as gambling, hacking, pornography and spam.

Karadata may use all necessary information from any and all Orders to comply with the data escrow retention requirements set forth by paragraph 3.6 of the RAA and other policies and procedures established by ICANN relating to escrow data retention.
